Brian Richard Fitzgerald, a New Jersey deputy attorney general, was arrested for creating and distributing AI-generated child sexual abuse material (CSAM). Authorities used digital forensics to trace the illegal activity linked to his Discord account.

In a notable and disturbing development, Brian Richard Fitzgerald, a deputy attorney general in New Jersey, has been arrested on felony charges related to the production and dissemination of AI-generated child sexual abuse material (CSAM). This case marks a rare instance of a high-ranking state legal official being accused of involvement in such criminal activity.

Authorities were alerted after the National Center for Missing and Exploited Children received a tip in July concerning a Discord user sharing illicit images. Law enforcement officials employed digital forensics and examined subscriber and IP records associated with the Discord account, ultimately linking the activity to Fitzgerald’s residence.

During a search, investigators recovered prompts and software scripts used to generate AI-created CSAM. Chat logs revealed that Fitzgerald, operating under the Discord alias “thegentlemanpervert_2160_07833,” allegedly admitted to producing multiple sexually explicit images of minors using artificial intelligence and sharing them with other users.

Fitzgerald, aged 51, has served as deputy attorney general since 2016, focusing on insurance fraud prosecutions. The charges he now faces include possession and dissemination of child sexual abuse material, as well as criminal use of a communication facility.

This case aligns with ongoing efforts by law enforcement agencies, including the U.S. Department of Justice, to crack down on AI-generated CSAM. Since as early as 2024, the DOJ has made clear that AI-produced CSAM constitutes illegal material subject to prosecution. Similar arrests have been made involving law enforcement personnel in other regions, including a recent Pennsylvania police officer and a case in South Korea.

New Jersey District Attorney Joe Khan emphasized the commitment to pursuing justice regardless of a perpetrator’s position, stating, “No one is above the law, least of all someone entrusted with upholding it.” This case highlights the growing challenges authorities face in combating AI-driven exploitation and their determination to hold offenders accountable.
